Terms and Conditions

By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by our Terms and Conditions presented on this page.

These terms and conditions apply to the purchase of goods and services from the PHERE.EU online store (hereinafter referred to as the Consumer) and the entrepreneur ATMOSPHERE DEVISER OÜ (hereinafter referred to as the Online Store phere.eu).

In addition to these terms, the legal relationships arising from the purchase of products from phere.eu are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS), and other applicable laws in the Republic of Estonia.

Validity of the Sales Agreement, Product, and Price Information

These terms and conditions apply when purchasing goods from the Online Store. The prices of the products sold in the online store are indicated next to the products. In addition to the price, a fee for the delivery of the goods is added. All prices for goods sold in the online store are in euros. All prices listed on phere.eu include a 22% value-added tax. The delivery fee depends on the buyer's location and the chosen method of delivery. The delivery fee is displayed to the buyer when placing an order. Information about the product is provided directly next to the product in the Online Store.

 

​Persons under eighteen years of age, can only place orders with the consent of the parent/guardian figure.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

Ordering Process

To order a product, add the desired items to the shopping cart. To complete the order, fill in the required fields and select a suitable method of product delivery. The screen will then display the amount to be paid, which can be securely paid through the following payment methods:

  • Estonian bank transfers: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay

  • Visa/Mastercard card payments

  • Based on the issued invoice Note: When paying with a bank link, be sure to click the "Back to the Merchant" button on the bank's page.

Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. Atmosphere Deviser OÜ is the data controller for personal data; Atmosphere Deviser OÜ forwards the necessary personal data for payment processing to the authorized processor Maksekeskus AS. The seller does not have access to the customer's bank and credit card details. The agreement comes into force upon the receipt of the amount due to the Online Store's bank account.

The owner of the Online Store is the responsible data controller for personal data and provides the necessary personal data for payment to the authorized processor Maksekeskus AS.

If the ordered product cannot be delivered due to the end of the product or for any other reason, the buyer will be informed as soon as possible, and the paid amount (including the cost of delivering the goods) will be refunded promptly, but no later than 14 days from the date of the notification.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Delivery

Goods are shipped to the following countries: Worldwide, except Russia and Norway. The buyer has the following options for receiving the goods: DPD, Itella parcel lockers, courier service, and the option to pick up the goods in person. The buyer bears the shipping costs, and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally reach the destination specified by the buyer within 2-7 working days from the effective date of the sales agreement. Outside Estonia, delivery takes place within 14 calendar days. In exceptional cases, the right to deliver the goods is extended to up to 45 calendar days.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity. To exercise the 14-day right of withdrawal, the ordered product must not be used in a way other than necessary to ascertain its nature, properties, and functioning, as permitted for testing in a physical store. If the product has been used for purposes other than necessary to ascertain its nature, properties, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount based on the decrease in the value of the product. To return the product, the buyer must submit a withdrawal statement for the purchase of the product and send it to the email address hello@here.eu within 14 days of receiving the product. The buyer must return the product within 14 days of submitting the withdrawal statement or provide evidence that they have handed over the product to the carrier within the aforementioned period. Upon receiving the returned product, the Online Store will promptly, but no later than 14 days from the receipt of the withdrawal statement, refund all fees received from the buyer under the contract. The Online Store may refuse refunds until it has received the returned item or until the buyer has provided evidence that they have returned the item, depending on which occurs earlier. If the buyer has explicitly chosen a delivery method different from the cheapest regular delivery offered by the Online Store, the Online Store is not required to refund the cost exceeding the cost associated with the regular delivery method.

Right to Claim

The Online Store is responsible for non-compliance with the terms of the contract or defects in the goods sold to the buyer, which existed at the time of delivery and which become apparent within two years from the delivery of the goods. Within the first year from the delivery of the item, it is presumed that the defect existed at the time of delivery. Rebutting this presumption is the obligation of the Online Store. If a defect is discovered, the buyer has the right to contact the online store within two months by sending an email to hello@phere.eu or calling +3725206723. The Online Store is not responsible for defects that occur after the goods have been handed over to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees paid by the buyer under the sales agreement. The Online Store will respond to the consumer's complaint in writing or in a form that allows written reproduction within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to transport companies to deliver the goods. The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a desire to receive them by entering an email address on the website and has indicated a willingness to receive direct mail messages. The buyer can unsubscribe from receiving offers and newsletters at any time by notifying us by email or by following the instructions provided in the email containing the offers.

Dispute Resolution

If the buyer has complaints about the Online Store, they must send them to the email address hello@phere.eu or call +3725206723. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer has the option to turn to the Consumer Disputes Commission.
